Art. 50 requires certain AI-generated or AI-assisted content to be made recognisable as such, so that people know they are dealing with AI. This mainly affects AI chatbots, deepfakes, AI texts on matters of public interest, and emotion recognition and biometric categorisation.
Legally binding from 2 August 2026. For systems already on the market before then, there is an additional transition period until 2 December 2026 for machine-readable labelling.
Everyone who publishes AI-generated content or uses chatbots – including founders, freelancers and SMEs, not just large companies.
Both are possible. A clear text notice such as "AI-generated" is legally sufficient, as is an icon. Using the official EU icons is voluntary. What matters is that the labelling is easy to understand and clearly recognisable.
